By telephone advertisement one understands telephone calls, which pursue the purpose, which calling a commodity or a service to sell (telephone sales).

Unwanted telephone advertisement is, just as fax advertisement and Spam (E-Mail) forbade, in Germany after "§7 exp. 2 and 3 of the law against the mean competition. Exception: A consent is present on the part of the calling. After the newest iurisdiction being present a business relation is not sufficient any longer than consent. Who has e.g. only one motor vehicle insurance with an insurance company, may be called only if it concerns a question to this special contract. A call, over for a product in another section to recruit is against it illegally. A consent for advertising calls must be given expressly. Of course such a consent can be also withdrawn.

As a consumer one can with warnings or, if that does not help, with provisional orders against it resists.
