The stop prohibition (HV) is regulated in Germany after road traffic regulations (StVO) by means of road sign (character 283 and 286 StVO) and after "§ 12 StVO. The official designation is stop prohibition, whereby the term is colloquially more common retaining prohibition.

Principles to the stop prohibition

In principle may be held everywhere, where it is not forbidden. Here entire road traffic regulations in its context is to be seen. Regulations for holding and/or to stop prohibitions are to be found scattered in the StVO. After "§ 2 StVO the roadway use is prescribed by vehicles. There it means simply: "Vehicles must use the roadway [...]. "Sidewalks do not belong to the roadway. On sidewalks generally may not be held and parked, also not halflaterally.

To differentiate is

  • Stop prohibition: it may not be held at all (except traffic-dependent, see control rooms)
  • reduced stop prohibition: Until 3 minutes (or to the loading or unloading etc.) is permitted to stops
  • Parks is defined in "§ 12 exp. 2 StVO: "Who leaves or than three minutes keeps its vehicle longer, which parks. "
  • Control rooms: If the travel is interrupted due to an arrangement or the traffic conditions, for example with a back-up or before a closed railway barrier, in the sense of the StVO one does not hold but one does not wait, and the stop prohibition does not come then therefore to carrying.
  • Remain lying: If the travel is interrupted due to a technical defect, then the driver holds, but does not remain likewise lying.

Stop prohibition after character 283 StVO

The stop prohibition, characterized by the character 283 StVO, forbids each form of stopping a motor vehicle on the roadway. In former times this indication was called also absolute stop prohibition.

Stop prohibition after "§ 12 StVO

After "§ 12 exp. 1 and 1a StVO is inadmissible holding

1. on confine and in unclear road places,

2. within the range of sharp curves,

3. on acceleration strips and delay strips,

4. on pedestrian crossings as well as up to 5 m before it,

5. on railroad overpasses,

6. so far it by following road signs or light signals is forbidden:

A. stop prohibition (character 283),
b. reduced stop prohibition (character 286),
C. roadway delimitation (character 295, letter b, bb),
D. Directional markers on the roadway (character 297)
e. Border marking for stop prohibitions (character 299),
f. red steady light ("§ 37 exp. 3)

7. up to 10 m before light signals and the indications "the rail traffic priority grants" (character 201), "right of way grants! "(Character 205) and "stop! Right of way grant! "(Character 206), if they are covered thereby and

8. before and in officially marked fire-brigade approach roads,

9. at (character 229).

10. in the driving area of rail-mounted vehicles

11. Holding is forbidden to taxes, if they use a driving strip, which is reserved them and the line buses, excluded at bus stops for the immediate in and stepping out letting of passengers.

Stop prohibitions according to other regulations

Since "§ the 12 StVO the stop prohibition does not regulate finally and exhaustively, also further regulations are to be considered:

  • After "§ 18 exp. 8 StVO holding is forbidden on motorways and force routes: ", Is forbidden to stops, also on Seitenstreifen. "
  • After "§ 9a exp. 1 StVO is forbidden within a roundabout holding on the roadway.
  • If a road is e.g. with character 250 StVO (prohibition of vehicles of all kinds) or character 242 StVO (beginning pedestrian zones, colloquially "pedestrian precinct ") for vehicles closed, may not be held or parked there also.

Reduced stop prohibition after character 286 StVO

The reduced stop prohibition, characterized by the character 286 StVO, forbids holding on the roadway for a longer period than three minutes. In former times this indication was called also park prohibition.

For in or stepping out and/or when the loading or unloading the time may be exceeded by three minutes however in the reduced stop prohibition, if the procedure is accomplished as briskly as possible.

Range of validity of the indications Z. 283 and Z. 286

Stop prohibitions are at the same time park prohibitions. They begin at the road sign and apply on the roadside, on which they stand, in driving direction up to the next crossing or inlet on the same side. Longer stop prohibition distances can be marked by arrows in the road signs. By an arrow in the sign, trailblazing of the roadway, is marked the end of the stop prohibition.

Stop prohibitions can be limited temporally (once per hour and week-daily).

Stop prohibition for a zone

By character 290 StVO (reduced stop prohibition of a zone) a whole range of validity can be occupied, similarly to a Tempo-30-Zone with a reduced stop prohibition; This reduced stop prohibition for a zone is again waived by character 292 StVO.

Within these zones exceptions can be created. So holding and parking in particularly ranges proven with indications can be permitted. Likewise parking with a Parkscheibe (character 291 StVO) can be permitted or with park light by Zusatzschilder; same applies to inhabitant parka etc. ice.

Exceptions and restrictions

  • By a Zusatzschild with pictogram holding in connection with characters 283 or 286 can forbid also holding on the Seitenstreifen.
  • White arrows in the characters 283 and 286 know the validity of the prohibition characteristic. At the beginning of the prohibition distance can be characterized by a horizontal white arrow pointing to the roadway in the sign, the end by such an arrow trailblazing of the roadway. With a road with two carriageways is called: An arrow arranged to the left forbids holding behind the indication, an arrow holding before the indication, arranged to the right. On the left side with one-way streets it turned around. With an arrow in both directions is both holding forwards, and behind the indication forbade. The arrows usually are in the lower blue segment of the indication.
  • By a Zusatzschild "inhabitant with special park document of identification freely "steps the stop prohibition for the person's group mentioned repealed, if the park document of identification mentioned is completely readably in the vehicle; See: Inhabitant parks.

Sanctioning

Drivers, hilfsweise vehicle owners, commit in Germany a traffic regulations adversity in accordance with the Grunddelikt additional "§ 49 StVO and "§ 24 traffic law; standardized in the federalin-uniform penalty catalog. For example the caution money amounts to as a rule 25 "€, if the driver/owner a Kfz parks other road users in the stop prohibition less than one hour and handicapped. A towing of the disturbing vehicle can be thus legitimate.
