Special vacation is a form of the vacation, which is granted to the person employed for special reasons lying in its person.

Employee

After "§ 616 BGB the employer is obligated to exempt the employee under continued payment of the purchases from the work obligation if it is not prevented for one "relatively" substantial time by a reason lying in its person innocently from the work. Which circumstances can represent such a reason, is disputed in the detail. Are called among other things: Heavy illness/death of a close member, care of a child gotten sick, own marriage ceremony, fulfilment of religious obligations, Niederkunft of the wife, participation in rare family celebration, partly also removal. Sometimes collective agreements contain concretizing regulations.

Besides many collective agreements see also to special vacation under omission of the purchases forwards (so e.g. "§ 28 collective agreement for the public service). In a closer sense even only this case is regarded conceptually than special vacation, while the cases "§ 616 BGB as "exemption", "work release" etc. are defined.

An official

For officials the special vacation is regulated in the SonderurlaubsVO of the federation and/or the parallel regulations of the countries. They contain detailed kasuistische enumerating, of the circumstances justifying the grant from special vacation.

To call are in particular

• The practice of civic rights and obligations (must, paid)
• Doing a freiwilligen social or ecological yearly (must, unpaid, only an official on sample/on revocation)
• The advanced training to the sister aid (target, paid)
• Purposes of the military or civilian defense (target, paid)
• Unionized purposes (target, paid)
• Technical, national political, church, sporty purposes (can, paid)
• Activity with supra-national/intergovernmental mechanisms (must, unpaid)
• Foreign language training/advanced training abroad (can, paid)
• Family home travels of separation money persons entitled (must, paid)
• Medical examinations/treatments/welfare cures (must, paid)
• Personal causes: Niederkunft of the wife, death of member, official removal, heavy illness of members (must, paid)
• Other personal causes (can, paid)
