By special signal one understands the warning of other road users before employment vehicles assistance about light signals and sound signals.

Germany

Germany is intended for special signals blue signal light and employment horn.

Conditions and legal regulation

The use of special signals is regulated in Germany in road traffic regulations (StVO) in "§ 38. Therefore using of the special signal is limited to few exceptional cases, in order to prevent the abuse. It may be used only, if highest hurry is required, over

  • To save human life or turn heavy health damage away,
  • to turn away a danger for public security or order,
  • to pursue volatile persons or
  • to receive important real values.
  • Consequences

    Special signal arranges: "All remaining road users have immediately free course to create" (see "§38 exp. 1 StVO). Free course to create means to drive for the other road users (also for the oncoming traffic) to possibility right of slowing down and if necessary of stopping their travel, in order to follow this arrangement. If the road is not broad enough, in order to make for a vehicle possible with special signal an overhauling, it can be also necessary to drive with normal speed of far until a place is reached, at which the employment vehicle overhaul can. On motorways and force routes the lane for employment vehicles is between that completely always links trace and the second trace from left to to form.

    The employment of special signal requires in principle no special rights after "§35 StVO. If the conditions for special signal are given, have however e.g. Police, fire-brigade and emergency service also special rights (see "§35 exp. 1 and StVO). Other vehicles, e.g. the accident auxiliary vehicles of the railways emergency manager, do not have special rights, but only above right of way. Offences against road traffic regulations are then however justified by state of emergency.

    Blue light alone without employment horn (Martinshorn) "may be used only by the vehicles equipped with it and only for the warning to accident or other employment places, during employment travels or with the company of vehicles or of closed federations" (see "§38 exp. 2 StVO). An employment travel without employment horn is thus permissible, required however of the driver a still higher attention, because the remaining road users can notice the purely optical signal substantially more badly. In addition they are not obligated to create free course.

    Austria

    In Austria there is not the term special signal. However the use of blue light and subsequent clay/tone horn is likewise in road traffic regulations, in "§ 26, regulated:

    (1) The steering wheels of vehicles, which are equipped with successive differently high tones according to the strength-drivinglegal regulations with lights with blue light or blue turning light and with devices for delivering alarm flags, may use these signals only with danger in the delay, for example during travels for and from the place of the urgent assistance or for the place of the other urgent employment. In addition the aforementioned signals may be used so far as necessarily only for the completion of a protokollarisch specified program for state visits or other acts of state as well as in fulfilment of international-law obligations. The lights with blue light or blue turning light may be used for reasons of the road safety also at the place of the assistance or the other employment or with official prescribed transportation company.
    (2) Except in the cases stated in exp. 3 the steering wheel of an employment vehicle is not bound during its travel to traffic prohibitions or at restrictions of traffic. It may not endanger however hiebei persons or damage things.
    (3)"Â… the steering wheels of employment vehicles may bring in also with red light into a crossing, if they continued before and convinced themselves that they endanger hiebei not humans or damage things. One-way streets and carriageways may drive on them in the opposite direction only if the place of work is not in the required time attainable differently not or"Â….

    Switzerland

    Swiss legislation speaks likewise not of special signals but of "special warning signals". In the article 27, paragraph 2 of the traffic law is called it:

    The road is to be released to the fire-brigade, medical and Polizeifahrzeugen immediately with noticing besondern the warning signals. Vehicles are to be if necessary stopped.

    The design of this article leads to a conversion in practice, which corresponds to those in Germany and Austria.

    A travel with blue light without siren or Martinshorn requests the other road users to increased caution, leads however in practice not to an automatic precedence right of the rescue vehicle. At the place of work to an orange warning lighting is changed over, blue warning lights is intended only for driving vehicles.

    Since 2003 vehicles of the rescue organizations can be equipped additionally to the Martinshorn also still with the US-American "Yelp "- signal. This signal is used to request in order to release road users, who Martinshorn and blue light did not notice (for example during an employment travel on the motorway), in addition the roadway.

    There are not the special rights, which have the fire-brigade members in Germany with the private vehicles during the travel to the base, in Austria and in Switzerland. It is however legally disputed, as far these special rights go with private vehicles.
