A society is predominant in the economical as well as in the legal linguistic usage one by legal transaction justified combination under private law of several natural or legal entities ("the partners ") for a common purpose.

The society thereby in particular distinguished from the community, at which not the common purpose, but the individual goals of the persons involved in the foreground is based and also often not on legal transaction, as well as of combinations of the public right.

Deviating from this far definition one limits strictly speaking the term "society "on (only limited legally responsible) the unincorporated firms ("§ 705 BGB) and differentiates it thereby from the association ("§ 21 FF. BGB), among which in particular also finance companies and cooperatives rank.
