Sickpay is in Germany a legally prescribed rule achievement of the legal health insurance with inability to work.

Conditions for the requirement

Apart from being present inability to work (=Versicherungsfall) it is for the requirement on sickpay a condition to be ill-insured with requirement on sickpay. This applies to the majority of the employees, to unemployed persons, as well as to independent ones, who locked a freiwillige insurance with requirement on sickpay with their health insurance company. With unemployed persons is to be considered, which only unemployment pay I receivers (unemployment relief receivers until 31 December 2004) have requirement on sickpay. Unemployment pay ii-receivers (starting from 1 January 2005) do not have a requirement on sickpay more, as far as they are not insured due to another facts with requirement on sickpay. They receive also with inability to work further unemployment pay II from the federal agency for work and/or the respective working group. In addition is a condition that by the inability to work income (e.g. Pay and/or income from is omitted.

Beginning of the sickpay payment

Sickpay is a payment indemnification, i.e. the achievement begins in principle with the day after omission of the regular income. With persons employed this is the end (usually of the payment continued payment. Also subscribers of unemployment pay have with continuous inability to work after six weeks requirement on sickpay. With the beginning of the achievement depends on the statute of the health insurance company and the selected insurance. Some legal cashes offer no insurance with sickpay, with others for independent ones can between beginning of sickpay starting from the first day or after several weeks be selected. Ever in former times the requirement for sickpay exists, the more highly is the contribution, which the independent one has to pay to the health insurance company. Many independent ones, which are insured with a legal health insurance company, select the option without requirement for sickpay from cost reasons and insure the loss of wages privately. Unemployed persons receive sickpay at height of the unemployment pay.

Achievement height

The gross sickpay is computed after the income before beginning of the inability to work. It amounts to 70 per cent of the last gross, but at the most 90 per cent net income. With the computation also the single payments are considered in the last 12 months before the inability to work. Regular overtime and deviations from the agreed upon payment affect the sickpay height positively. Regularly it means e.g. with overtime that in the last three accounted for months before entrance of the inability to work per month at least one overtime must have resulted. With varying payment (e.g. Piece-work wage) is at the basis put the average of the last three months.

The sickpay is in principle contributory to the pension, unemployed person and nursing care insurance. The contributions are exhausted directly from the health insurance company to retain and to the appropriate insurers. The health insurance company takes over the quotas of the employer (at employees) during the sickpay purchase, whereby these are considered only to 80 per cent (rule payment). In the health insurance noncontributoryness exists during the purchase of sickpay. With unemployed persons the contributions from the sickpay are paid completely by the health insurance company. The computation of the sickpay takes place for the calender date. Reference times of sickpay are taken into account of pension and unemployment insurance as contribution periods.

The net sickpay approximately 75 per cent (dependent on the general obligation to pay contribution and the auxiliary contribution for child lots in the nursing care insurance) of the regular net earnings amounts to effective.

With receivers of unemployment pay the sickpay at height of the amount of achievement of the unemployment pay is granted.

Manner of payment

If the requirement for sickpay exists for a whole calendar month, then the recipient of services receives sickpay for 30 days. In partial months sickpay is paid for the number of the actual calender dates in this month.

From the application of this Dreissigstel regulation a distortion results with beginning or end of sickpay payments in February: The employer pays content for those days, on which the employee is present, thus e.g. of 1.2. until 15,2. for 15 days (15/30 of the content). The health insurance company pays sickpay for the time of the 16.2. to 28.2. , thus for 13 days (13/30). 2 days (2/30) remain here thus unconsidered, for which the employee receives then neither content nor sickpay.

If this disadvantage is to become balanced by the employer, shortening the content must take place after calender dates. In the above case of example the employee would refer 15/28 of its content then from the employer, so that the computational content loss is reduced.

Leistungsdauer

Because of the same illness sickpay is paid for 78 at the latest weeks within one period of three years (block period). This three-period of one year is a rigid period (see example) and begins in principle with the first occurrence of an illness. Another illness produces a new independent three-period of one year.

Example: Inability to work times due to a back illness (illness of a same cause):

The first three-period of one year runs from 12 December 2001 to 11 December 2004. The second three-period of one year of 12 December 2004 until 11 December 2007.

Due to the inability to work of 14. March 2005 exists thus a requirement on sickpay for 78 weeks, since a new block period began and the Vorerkrankungszeiten is not considered from the first block period thus.

Comparable achievements

The sickpay similar achievements are the hurting money of the legal accident insurance (with inability to work because of industrial accident, way accident or occupational illness, the transition money of the legal old age pension insurance (with inability to work because of participation in a measure for medical rehablitation and the transition money of the federal agency for work with vocational rehablitation. Additionally there is still supplying sickpay, which of the office for supplying for inability to work times because of a supplying suffering (e.g. Military service damage is carried out). Hurting money and supplying sickpay become from the health insurance company, with which the receiver is insured auftragsweise for the accident insurance carriers (e.g. Professional association) or the office for supplying disbursed. The health insurance companies account for then the laid out achievements with the responsible carrier. Furthermore there is still the patient daily allowance insurance as loss of wages insurance during a private health insurance. With this however the term of the inability to work (here 100% OUTER as a condition of a performance demand) differs as well as the Leistungsdauer, i.e. for an unlimited period and/or, until then inability to work occurred in the exercised occupation in accordance with the standard terms.
