The duration and form of the radio advertising are regulated in the broadcast state contract.

Definitions

"Advertisement" in the sense of the broadcast state contract is

each expression with the practice of a trade, a trade, a handicraft or a free occupation, those in the broadcast is sent of a public or private organizer either against payment or a similar return or as self-advertisement with the goal, the paragraph of goods or the contribution of services, including immovable things, rights and obligations to promote against payment. ("§ 2 exp. 2 No. 5 RStV).

"Schleichwerbung" in the sense of the broadcast state contract is

the mention or representation of goods, services, names, marks or activities of a manufacturer of goods or a Erbringers of services in programs, if it is intentionally intended for advertising purposes by the organizer and the public can mislead regarding the actual purpose of this mention or representation. A mention or a representation is considered in particular as for advertising purposes intended if it takes place against payment or a similar return. ("§ 2 exp. 2 No. 6 RStV).

"Sponsoring" in the sense of the broadcast state contract is

each contribution of a natural or legal entity or a person combination, who is not involved in broadcast activities or in the production of audiovisual works, to the direct or indirect financing of a transmission, in order to promote the name, the mark, the appearance of the person or person combination, its activity or its achievements. ("§ 2 exp. 2 No. 7 RStV).

"Teleshopping" in the sense of the broadcast state contract is

the transmission of direct offers to the public for the paragraph of goods or the contribution of services, including immovable things, rights and obligations, against payment. ("§ 2 exp. 2 No. 8 RStV).

Regulation extent

Public broadcast

In the public broadcast television commercial is only in the program of pool of broadcasting corporations and Second Channel of German Television permissible, however only from Monday to Saturday in each case to 20:00 clock. In further country widely spread programs of pool of broadcasting corporations and Second Channel of German Television as well as in the third television programs advertisement is not permissible. The total period of the advertisement may amount to 20 minutes work daily in the annual average maximally, within one period of one hour however no more than 20%. Circuit breaker advertisement (thus advertisement within a current transmission) is permitted only into tracing (sport) meetings or with transmissions of more than 45 minutes of duration (inclusive advertisement). Transmissions of services and transmissions for children may not be interrupted. In public sound broadcasting one total period of the advertisement is up to 90 minutes work-daily permitted.

Private broadcast

In the private broadcast advertisement is permitted to a far larger extent. Circuit breaker advertisement is in principle permitted, between two interruptions within a transmission is however at least 20 minute to lie. "Transmission of audiovisual works such as cinema features and television films with exception of series, rows, light maintenance transmissions and documentary films [can however] for each full period of 45 minutes to be once interrupted, if their programmed transmitting time is more than 45 minutes. A further interruption is permissible, if the programmed transmission duration goes around at least 20 minutes beyond two or several full 45 minute periods." ("§ 44 exp. 4 RStV) "newscasts, transmissions to the political Zeitgeschehen, documentary films and transmissions of religious contents, which have a programmed transmitting time of less than 30 minutes, [may] by advertisement or Teleshopping not to be interrupted." ("§ 44 exp. 5 RStV). As also in the public broadcast transmissions of services and transmissions for children may not be interrupted. The portion of transmitting time for advertising spots may not exceed 15% of the daily transmitting time. Within one hour the portion of the transmitting time for advertising spots and Teleshopping Spots may not 20% exceed.

Other broadcasting stations in Germany

The transmitters in Germany did not station allied armed forces (AFN, BFBS) radiate advertisement. This applies also to the foreign services "Voice OF America", "Voice OF Russia" and "radio Free Europe".
