Partynear donations are the political parties in Germany intimate institutions for the purpose of the political education, which are strictly from them intimate political parties separate however for legal reasons. Everyone of the parties represented in the Bundestag co-operates with one its political principles representing donation. These donations are financed by means of the Federal Ministry of the inside (BMI) and the Federal Ministry for economic co-operation and development (BMZ) as well as by Spenden.Die tasks of the partynear donations are above all the political education of the population, the talented promotion and development co-operation.
After the legal form it can be donations in the actual sense (e.g. the Friedrich Naumann donation), mostly concerns it however registered associations (e.g. the Luxembourg donationdonation Luxembourg donation).
The efforts of the party to establish a Franz donation as donation under private law no success had granted the republicans (BVerwGE 106, 177; NJW 1998, 2545). Supervision of donation and courts justified the refusal of permission thereby, the planned donation endanger the public interest. These decisions are encountered in the donation-legal literature broad refusal, because the statements referred to the behavior of individual party members, not however to the concretely formulated statute purpose.
