The official administration is execution proceedings, which are subject to the regulations of the judicial code (ZPO). The official administration procedure is legally regulated in the law over the auction by order of the court and the official administration (ZVG).

It is one of the possibilities of executing into the immovable fortune. To the immovable fortune among other things (cultivated and vacant) properties, hereditary building laws belong and with separate estate connected co-ownership portions (residential property).

The procedure is accomplished with the responsible district court as enforcement court by a right male nurse. The administration is transferred here to an official receiver, who it is incumbent on to draw in the rents and to secure the normal and management worth-holding of the object from the incomes.

In contrast to the auction by order of the court, in which the creditor looks for the satisfaction of his requirements from the substance (utilization) of the real estate, in the context of the official administration the incomes obtained from the object (rent, lease) are distributed, after departure of the rationing costs, on the basis one of the court of provided partition plan by a judicially ordered and supervised official receiver to the creditors after a legally determined order of rank.

Creditors can operate auction by order of the court and official administration at the same time. After distribution of the addition in the auction the official administration is waived.
