Industrial law is a part of the special administrative law, which serves above all the danger warning. The industrial law is part of the restaurant administrative law.

The industrial law is at the same time delimitation of the freedom of trade, one of the oldest civil rights in the modern state. The industrial law strictly speaking makes special demands against the manufacturing one. Usually this is obligated to member, in an obligation combination like the Chamber of Commerce and industrie, chamber of trade, to become chamber of economics Frequently also special demands are made in the context of the "reliability" against the manufacturing one.

Germany

Constitutionally the industrial law is in Germany supported by kind 12, 14, 2 exp. 1 of the Basic Law.

Most important standardisations of the industrial law strictly speaking in Germany are:

• the trade and industrial regulations
• the handicraft ordinance
• the licensing act
• the law regulating the closing time of shops
• the transportation of human beings law,

in addition, numerous laws pertaining to labour law with a order-legal character (like e.g. industrial safety law among other things)

The dangers outgoing from commercial plants (industrial law in the broader sense) are caught today by the majority by the environment law. Most important standardisation is thereby the federal immission control law.

Austria

In Austria the standardisations of the industrial law in the trade and industrial regulations are fixed 1994 (novella 2002). It is valid for all professionally exercised activities, with some exceptions like for example physicians, attorneys, civil technicians and so-called "free occupations" (artist etc.). The following regulations are contained in the trade and industrial regulations:

• general entrance regulations
• personal conditions (capability, reliability)
• material conditions (equipment, need - only with the trade of the Rauchfangkehrer)
• Organization of an industrial concern (carrier person or - society, managing director, name guidance)
• Permission of equipment

Besides there are numerous further laws and regulations from the ranges to industrial law, corporate law and environment law.

For manufacturing ones the membership in the Austrian chamber of economics is prescribed obligating.
