The guideline 2001/95/EG of the European parliament and the advice from 3 December 2001 over general product security is a European guideline. The regulations contained in it are to guarantee that in Europe into traffic products brought for consumers are safe (article 1).
In accordance with article 2 a "product" is in the sense of this guideline "each product, which - also in the context of the contribution of a service - is intended for consumers or could under reasonably foreseeable conditions by consumers be used ("Â….) independently of whether it is newly, used or reprocessed. "
In further 20 articles is defined, as well as what as "safe product "is to be regarded implementing provisions stated.
The member states of the European union are obligated to set the necessary national on the right of and administrative regulations into force in order to follow this guideline starting from 15 January 2004.
In Germany this happened with the new equipment and product safety law, which stepped on 6 January 2004 into force and which replaced valid product safety law before. In Austria the conversion of the guideline with the product safety law took place 2004, BGBl. I No. 16/2005, which replaced the product safety law 1994.
The guideline 92/59/EWG before available to the same range of topics was waived to 15 January 2004; References to this guideline apply in accordance with the article 22 since then as references to the new guideline 2001/95/EG.
