The guideline on externally stored data storage is a guideline of the European union, by which the different national regulations of the European Union member states are to be harmonized for storage by telecommunications data on supply. It is to be guaranteed by the harmonization that the data for a certain period are kept for the purpose of the determination and pursuit by heavy criminal offences.

The guideline is politically and legally disputed. While their proponents call externally stored data storage indispensable instrument for the counterterrorism and prosecution, its critics refer to the associated interferences into the of the citizens, who regard her as the further step to the monitoring state.

Contents

The guideline obligates to be issued the member states of the European union, national laws, after those determined data, which result during the supply and use of public electronic communication services, by which service tenderers on supply be stored must.

To be stored are in particular traffic data and location data. Contents data - thus contents of enamels and telephone calls - are not to be stored.

Storing data

The following data categories must be stored on supply:

  1. for the backtracing and identification of the source of a message needed data:
    1. concerning telephone fixed net and portable radio:
      1. the call number of the calling connection,
      2. the name and the address of the participant and/or registered user
    2. concerning Internet entrance, Internet E-Mail and Internet Telefonie:
      1. the assigned user identification,
      2. the user identification and the call number, which are assigned to each message in the public telephone network,
      3. the name and the address of the participant and/or registered user, a IP address, a user identification or a call number at the time of the message were assigned to who;
  2. for the identification of the addressee of a message needed data:
    1. concerning telephone fixed net and portable radio:
      1. the selected (n) number (n) (the call number (n) of the called connection) and with auxiliary services such as call forwarding or Rufumleitung the number (n), to which the call is led,
      2. the names and addresses of the participants or registered users;
    2. concerning Internet E-Mail and Internet Telefonie:
      1. the user identification or call number of the intended receiver of a call by means of Internet Telefonie,
      2. the names and addresses of the participants or registered users and the user identification of the intended receiver of a message;
  3. for the regulation of date, time and duration of a transmission of news needed data:
    1. concerning telephone fixed net and portable radio: Date and time of the beginning and end of a communication procedure;
    2. concerning Internet entrance, Internet E-Mail and Internet Telefonie:
      1. Date and time of on and notice of departure with the Internet entrance service on the basis of a certain time belt, together with the dynamic or static IP address assigned by the Internet entrance offerer of a connection and the user identification of the participant or the registered user;
      2. Date and time of on and notice of departure for an Internet E-Mail service or an Internet telephone IE service on the basis of a certain time belt;
  4. for the determination of the kind of a transmission of news needed data:
    1. concerning telephone fixed net and portable radio: the taken up telephone service;
    2. concerning Internet E-Mail and Internet Telefonie: the taken up Internet service;
  5. for the determination of the final mechanism or before-bleached the final mechanism of users needed data:
    1. concerning telephone fixed net: the call numbers of the calling and the called connection;
    2. concerning portable radio:
      1. the call numbers of the calling and the called connection,
      2. the international mobile subscriber identification (IMSI) of the calling connection,
      3. the international portable radio device identification (IMEI) of the calling connection,
      4. the IMSI of the called connection,
      5. the IMEI of the called connection,
      6. in case of before-paid anonymous services date and time of the first activation of the service and the identification of the location (Cell ID), at which the service was activated;
    3. concerning Internet entrance, Internet E-Mail and Internet Telefonie:
      1. the call number of the calling connection for the entrance over dial-up subscriber station,
      2. digital Teilnehmeranschluss (DSL) or another terminator point of the author of the communication procedure;
  6. for the determination of the location of mobile devices needed data:
    1. the location identification (Cell ID) with beginning of the connection,
    2. Data for the geographical detection of radio cells by reference to its location identification (Cell ID) during the period, in which the supply storage of the communication data takes place.
