A freight contract is a contract over the transport of goods or goods.
In Germany a freight contract is a contract type of the commercial law. Right-systematically it belongs to the law of carriage.
By the freight contract the carrier, it from the sender commits itself to promote carrier or a preceding carrier handed over freight against payment (freight) to receiver determined by the sender. The legal relation between senders and carriers is in the commercial code (HGB) in "§"§ the 407 FF. in detail regulated. Besides and numerous further legislation to the individual modes of conveyance (on the road, on the rail, to water and in air) (e.g. ADSp, CMR, CIM, EVO, Warsaw agreement) applies usually even with priority. Their applicability depends in individual cases also on between which countries transport takes place. Because of the multiplicity of the possible drop organizations and the applicable in each case regulations the law of carriage belongs to the more difficult right subjects, which are controlled completely only by specialists. Essays and iurisdiction to the law of carriage are published in their own technical periodical named law of carriage (TranspR).
The freight contract is from the forwarding contract ("§"§ 453 FF. To differentiate HGB). The carrier is obligated to the transport of the freight; the carrier only for the provision of transport. The provision consists usually of the fact that the carrier assigned by the sender an order for forwarding business assigns for his part one or more successive carriers the actual freight contract for the transport of the freight.
