The formal administrative proceedings are a special procedure of the German administrative law. In the administrative proceedings law of the federation it is regulated in VwVfG and the following regulations.

Contrary to the not-formal administrative proceedings here strict formal requirements apply. So a request is to be placed always in writing. The procedure-taken part have numerous obligations leaned against the legal proceedings. A verbal negotiation has to precede the decision of the administrative authority. The decision is to be made always in writing and justified. It is to be set the involved one.

The formal administrative proceedings take place only due to special legal arrangement. The not-formal procedure forms the normal case in accordance with VwVfG. Formal administrative proceedings are for example the Enteignungsverfahren in accordance with "§"§ 104 FF." BauGB and the examination procedure after "§ 19 WPflG. In the administrative practice only a subordinated meaning comes to the formal procedure. The regulations in the administrative proceedings law have here only a model character. The legislator can refer to it, if it the opinion is that a formal procedure is necessary.
