The driver is that person, the one equipment for progressive movement, a vehicle, (bicycle, Kfz etc.) consciously steers or steers (leads). Colloquially one speaks of the driver or steering wheel, the term driver is against it in legal definitions and regulations to the traffic law.
The obligations of the driver with the participation in the traffic are in Germany in road traffic regulations (StVO), in Austria in road traffic regulations (Austria). For the permission from persons to the traffic the driving licence regulation is relevant in Germany (ehem. part of A of the StVZO, "§"§ 1 - 15 l StVZO).
Thus one requires the so-called driving capability of a driver. That means that the person must be able, prudently, to lead soberly and above all surely the vehicle.
