Domestic help is in Germany a social security benefit, which is granted by the legal health insurance or the legal old age pension insurance. For the achievement contribution the health insurance companies and/or responsible in each case the old age pension insurances for the insured one are responsible.

The domestic help covers all activities, which belong to leading a household, like e.g. care of children, meal preparation, housing cleaning, dress care etc. the range of the achievement depends on the individual in each case, actual assistance need. If the household can be still partly resumed or if the housekeeping is possible by another person of the household (e.g. weekend, vacation of the life partner) at certain times, then the achievements can be granted only to reduced extent.

A condition for the achievement

Under certain conditions the insurance takes over the costs of a domestic help, if the continuation of the household cannot be guaranteed for example because of a hospital treatment or an achievement for rehablitation.

Competence of the legal health insurance

Forms of the domestic help

Domestic help can be furnished by the health insurance companies in different forms. The first, however in practice rather rarely used possibility is that the health insurance company places a domestic help in form of a replacement. It can concern special employees of the health insurance company or around coworkers of institutions, with which the health insurance company closed corresponding contracts. This is not possible can to appropriate extent the costs of procured replacement be refunded. As appropriate here costs of 7,50 euro per hour and/or 60 euro are considered for each to day (2005). It can concern e.g. auxiliary workers of social service buildings or similar social mechanisms, in addition, private people can be engaged as a domestic help.

It is to be noted that for relatives and up to the second degree costs are not refunded. The cashes transfer necessary travel costses and a possible loss of wages, e.g. at unpaid vacation of the partner, in these cases however this are in practice the most frequent kind of the domestic help. The reimbursement of costs in these cases regulates the statute of the health insurance company, usually is limited refunding on the maximum amount of the costs of a Kraft posed (60, - euro per day). In addition, some cashes refund the full loss of wages.

Rule achievement (with all health insurance companies directly)

Achievement basis is "§ 38 SGB Vth requirement on domestic help can because of hospital treatment, medical precaution achievements, a Vorsorgekur for mothers, a medical rehablitation measure or because of a mother recovery cure exist, if because of one of these achievements the continuation of the household is not possible. Even if for medical reasons the Mitaufnahme with a child is necessary in the hospital, requirement on domestic help exists.

A condition is that in the household a child lives no other person, who lives these in the household resume can under 12 years and. Of it children, who are dependent on assistance handicapped and, in these cases do not form an exception apply the age limit.

During ambulatory patient treatment in principle no performance demand exists.

Increased output as provision in the articles (cash individual)

The health insurance company can plan in its statute that in further cases after medical certification domestic help is granted, e.g. when illness (without hospitalization) or after ambulatory operations. Contrary to the rule achievement this is however different from cash to cash.

Requirement duration

The duration of the achievement determines itself after the duration of the causing achievement, e.g. the duration of the stationary hospitalization.

Additional payment

Since an additional payment must be carried out 1 for January 2004 to the costs of the recourse to of a domestic help. This amounts to 10 per cent of the costs per achievement day, however at least 5, - and at the most 10, - euro daily. This applies only to Versicherte of age.

Domestic help when pregnancy and relieving (with all cashes directly)

Conditions for achievement

Legal basis for this achievement is "§ 199 RVO (Reich Insurance Code). The achievement is granted, if the continuation of the household is not possible because of pregnancy or relieving and nobody can resume these otherwise in the household. Contrary to the domestic help after "§ 38 SGB V it is not in these cases a condition that a further child in the household lives. The law demands only that the insured woman has a household and these also led. In addition the pregnancy and/or relieving must be the achievement cause, with other causal illnesses received also pregnant woman and mothers achievements after the SGB V. the pregnancy actually only in exceptional cases there is causal (e.g. with medically ordered bed peace), is the more frequent case of achievement relieving.

Domestic help can be granted both when stationary relieving and with a house birth.

Leistungsdauer

Domestic help when pregnancy or relieving is not subject to temporal restriction, her is so long carried out, how this is judged on the part of the physician or the midwife for necessary. Also after relieving in principle requirement exists, if the woman is still weakened by the consequences of relieving. Domestic help in the sense of the RVO is furnished after relieving however in principle only for the relieving day and the next six days.

Additional payment

With domestic help because of pregnancy or relieving no additional payment becomes due.

Domestic help with medical rehablitation

The health insurance companies carry out also domestic help after "§ 54 SGB IX, if the continuation of household is not possible because of a rehablitation measure of the health insurance. Otherwise the regulations of the SGB V. apply as characteristic are possible in these cases frequently in place of the domestic help the taking along of the child/the children to the rehablitation place similar to.

Alternatively also care of children costs up to monthly 130 euro can be taken over. Because of the small amount of achievement this possibility is however selected only rarely.

Cash competence

For the grant of the domestic help always the health insurance company is responsible, which furnishes the "main achievement", e.g. the hospital treatment. Example: A woman takes domestic help up because of a hospital treatment. The married man takes unpaid vacation for the supervision of the children and would like the loss of wages refunded to get. For it the health insurance company of the woman is responsible.

Competence of the legal old age pension insurance

If the domestic help becomes necessary because of a rehablitation measure debited to the old age pension insurance, then the old age pension insurance concerned is to be care of children-responsible also for the domestic help and/or. In these cases of the Mitaufnahme of the child/the children into the rehablitation mechanism use is mostly made. Legally the domestic help of the old age pension insurance orients itself on "§ 54 SGB IX.
