A conversion deficit is present, if a EEC guideline is converted not in by their set period or incorrectly by a member state into national right. The Nichtumsetzung is considered as offence against the EEC contract. Therefore a violation of contract procedure in such a way specified can be introduced against the member state. Perhaps the respective guideline attains despite missing conversion direct effect.

The conversion deficit amounted to 2003 on the average 2.4 per cent per member state, after it in the previous years (1992: on the average 21.4 per cent) was continuously declining (2002: 1.8 per cent). The percentage reflects thereby the portion within the prescribed period not converted of the guidelines in relation to all guidelines which can be converted.

The Federal Republic of Germany is at present with the conversion of different anti-discrimination guidelines to delay. The anti-discrimination law of the government had been rejected by the Upper House of Parliament; the government Merkel submitted still no new bill.
