Consumer contract

The civil law book mentions the "consumer contract" under anderm one in "§355, that so-called right of revocation with legal definition stands in "§310 III, it concerns thus literally contracts "between an entrepreneur and a consumer (consumer contracts)". With the present Treaties it can act around different kinds of contracts (purchase, serving, work contracts etc.). It is important that the parties are consumers and/or entrepreneurs.

The terms consumers and/or entrepreneurs are regulated as follows:

  • Consumer ("§13): "Consumer is each natural person, who locks a legal transaction for a purpose, neither their commercial nor its independent vocational activity to be added can." Crucially thus the purpose of the business is, thus is also a businessman, who buys privately a vehicle, a consumer.
  • Entrepreneur ("§14 I): "Entrepreneur is a natural or legal entity or a legally responsible unincorporated firm, those at the time of conclusion of a legal transaction in practice of its commercial or independent vocational activity acts."
