The buyer is the trade partner of a salesman, a natural or legal entity, who closes a sales contract with the salesman, i.e. a commodity and/or a thing conveyed gets is and itself obligates an equivalent to convey the purchase price. It participates important that there are two agreeing declarations of intention of buyer and salesman. The rights and obligations for the buyer result to 433ff BGB if necessary from the sales contract, "ยง and from the general trading conditions.
The rights of the buyer are first of all the conveyance of the commodity at with the sales contract agreed upon the time, in the agreed upon quality and at the agreed upon place. The obligations of the buyer are first of all the acceptance of the commodity and the conveyance of the payment of the commodity in the agreed upon form, to the agreed upon time and at the agreed upon place. With a purchase the buyer usually pays the salesman with money for a commodity or a service. In addition, the exchange can be a form of the purchase. Rights and obligations of the buyer generally apply from the sales contract are only derived. If no regulations are met there, seize - if available - the general trading conditions. If no regulations are present there, legal regulations seize. The sales contract and the general trading conditions may not contradict however the law.
